| dc.description.abstract | Osmanlı’da hukuk şer’i ve örfî olmak üzere ikiye ayrılmıştır. Her iki hukukun tatbiki için şer’iyye mahkemeleri kurulmuş ve bu mahkemelerde birçok anlaşmazlıklar kadılar tarafından çözüme kavuşturulmuştur. Osmanlı Devleti XVIII. yüzyılda Avrupa devletleri karşısında aldığı yenilgiler yüzünden III. Selim (1789-1807) döneminden itibaren askerî, siyasî, sosyal, vb. alanda yenileşme hareketlerine başlamış ve bu yenileşme hareketinden Osmanlı’daki hukuk sistemi de etkilenmiştir. Tanzimat döneminde Osmanlı hukukunun tatbik edildiği şer’iyye mahkemelerinde bir takım ıslahatlar yapılmıştır. Osmanlı hukuk müessesesine nitelikli hukukçuların yetişmesi için 1854 yılında Muallimhâne-i Nüvvâb, 1870 yılında Adliye Dershanesi ve 1874 yılında Mekteb-i Sultânî dâhilinde hukuk mektebi açılmış olsa da bunlar birtakım sebeplerden ötürü kapatılmıştır. Osmanlı Devleti’nde kalıcı hukuk mektebi 1880 yılında açılmış ve bu hukuk mektebinin İstanbul haricinde açılması için hemen harekete geçilmiş ise de bu mümkün olmamıştır. Ancak İstanbul haricinde Selanik, Konya ve Bağdat’ta hukuk mekteplerinin açılması II. Meşrutiyet döneminde olmuştur. Bu çalışmada; Bağdat’taki hukuk mektebinin açılışı, idarî ve öğretim kadrosu, mektepteki eğitim-öğretim ve talebelerin durumu ayrıntılı bir şekilde incelenmiş ve böylece Bağdat’ın Osmanlı Dönemi’ndeki yükseköğretim yapısı ortaya konulmaya çalışılmıştır. | en_US |
| dc.description.abstract | In the Ottoman Empire, law was divided into two as shar'i and custom. For the application of both laws, sharia courts were established and many disputes were resolved by the kadis in these courts. Ottoman Empire because of the defeats in the face of European states in the 18th century since the III Selim period, military, political, social, etc. started innovation movements in the field and the legal system in the Ottoman Empire was also affected by this innovation movement. During the Tanzimat period, some reforms were made in the sharia courts where Ottoman law was applied. Although the Muallimhâne-i Nüvvâb in 1854, the Adliye Dershanesi in 1870 and a law school within the Mekteb-i Sultani in 1874 were opened in order to train qualified lawyers in the Ottoman law institution, these were closed due to some reasons. In the Ottoman Empire, a permanent law school was opened in 1880 and although it was immediately taken to open this law school outside of Istanbul, this was not possible. However, besides Istanbul, the opening of law schools in Thessaloniki, Konya and Baghdad ıt was during the constitutional II period. In this study; The opening of the law school in Bağdat, the administrative and teaching staff, the education and training in the school and the situation of the students were examined in detail, and thus the higher education structure of Baghdad in the Ottoman Period was tried to be revealed. | en_US |
