dc.description.abstractTüm dünyada yaşanan Covid-19 salgın hastalığı, gündelik hayatta maske takma zorunluluğu, mesafeli sosyal hayat, uzaktan eğitim ve selamlaşma gibi önemli etkiler doğurmuştur. Salgın hastalık dönemine denk gelebilecek bir seçimde, hastalığın seçmen davranışları üzerinde de etkileri olacağı kuşkusuzdur. Hastalığın kapalı ortamlarda ve insandan insana solunum yoluyla daha hızlı yayılabilmesi dikkate alındığında, salgın hastalık, seçmenlerin oy verme isteklerini azaltabilecektir. Bu durum ise temsilde adalet ve yönetimde istikrar ilkelerinin işlerlik kazanmasına engel olacaktır. Bahsi geçen olumsuz neticelerin önüne geçilebilmesi için uzaktan mektupla oy kullanma yönteminin faydaları bulunmaktadır. Mektupla oy kullanma yönteminin seçim güvenliği bakımından riskler taşıdığı da bir gerçektir. Anayasa Mahkemesi mektupla oy kullanma yöntemini seçimlerin serbestliği ve gizliliği ilkesine aykırı bulmuştur. Bununla birlikte salgın dönemine denk gelen bir seçimde temsilde adalet ve yönetimde istikrar ilkelerinin sağlanabilmesi için yeni bir yasal düzenleme ile bir B planı olarak mektupla oy kullanma yönteminin düzenlenmesi mümkündür. Yasal düzenleme yapılırken ise seçim güvenliğini temin edebilecek asgari yasal güvencelerin öngörülmesi gerekir.en_US
dc.description.abstractThe Covid-19 epidemic disease experienced all over the world has had important effects such as the obligation to wear masks in our daily lives, distance social life, distance education and greetings. There is no doubt that the disease will have an impact on voter behavior in an election that may coincide with the epidemic period. Considering that the disease can spread more rapidly in closed environments and from person to person by respiratory route, the epidemic may reduce the willingness of voters to vote. This situation will prevent the principles of fairness in representation and stability in administration from becoming operational. In order to prevent the aforementioned negative consequences, there are benefits to the remote voting method. It is also a fact that the method of voting by letter carries risks in terms of election security. The Constitutional Court found the method of voting by letter contrary to the principle of freedom and confidentiality of elections. However, in an election coinciding with the epidemic period, in order to ensure the principles of fairness in representation and stability in administration, it is possible to regulate the method of voting by letter as a B plan with a new legal regulation. While making legal arrangements, minimum legal guarantees that can ensure election security should be envisaged.en_US
