Özet
Anayasa’nın 125’inci maddesinin son fıkrası uyarınca idare, kendi eylem
ve işlemlerinden doğan zararı ödemek zorundadır. İdarenin bir eyleminden
kaynaklanmasa da terör eylemlerinden dolayı kişilerin uğradıkları zararların tazmin
edilmesinde doktrin ve yargı mercileri tarafından yeni sorumluluk sebepleri kabul
edilmiştir. Terör eylemlerinden zarar gören kişinin asker veya sivil olmasına göre
açılacak tam yargı davasında görevli yargı mercii farklılaşmaktadır. Eğer terör
eyleminden zarar gören asker kişi ise ve askeri hizmet ile bağlantılı olarak terör
eylemlerine maruz kalmış ise açılacak olan tam yargı davasında görevli yargı mercii
AYİM olacaktır. İdari yargı alanında idare mahkemeleri genel görevli yargı
mercileri olarak kabul edildikleri için, AYİM’in görev alanına girmeyen tam yargı
davaları idare mahkemelerinin görev alanına girecektir
In accordance with the last clause o Constitution’s 125th Article, the administration is obliged to pay for the damages which has arisen due to its own actions and proceedings. New liability grounds have accepted by the doctrine and judicial authorities in the compensation of the damages individuals have incurred due to terrorist actions even though they have not arisen from an action of the administration. The incumbent judicial authority vary in the full remedy action to be filed according to the military or civil status of the individual who has incurred damages in terrorist actions. If the individual who has incurred damages due to the terrorist action is a soldier and has been subjected to terrorist actions due to his/her capacity as a military personel, meaning as associated with his/her military service, the incumbent judiciary authority in the full remedy action to be filed shall be AYİM. As the administrative courts are accepted as judiciary authorities with general competence in the field of administrative justice, the full remedy actions which do not fall into AYİM’s remit shall fall within the remit of administrative courts
