| dc.description.abstract | Bu Tezimde îslamjıukukunda Butlan Nazariyesini ele alıp, konunun daha iyi bir şekilde anlaşılabilmesi için Modern hukuktaki Butlan Nazariyesi ile mukayese yaptık.Tez çalışmamızda konuyu üç bölüm olarak ele aldık.Butlan'ın aslında bir müeyyide türü olmasından dolayı, birinci bölümde genel anlamda ımıeyyjdejsr konusunu, ikinci bölümde tezimizin asıl konusu olan Butlan nazariyesini hem İslam hukukunda hem de Modern hukukta olmak üzere ayrı ayrı inceleyerek, üçüncü bölümde ise mukayeseli hukuk açısından değişik yönlerden ele almaya çalıştık. Bu tez çalışmamızda Butlan nazariyesi ile ilgili tespit ettiğimiz önemli noktalar tezimizin sonuç bölümünde yer almaktadır. | |
| dc.description.abstract | In this thesis, we discussed Butlan Theory in islamic Law and compeared with Butlan Theory in Mordern Law in order to be understood weel, in my thesis study, we scrutinited the subject in three sections. As the Butlan is a kind of sanction in the first section generally by discussing sanctions and in the second section we studied Butlan Theory the main plot of our thesis which is found in both islamic Law and modern Law and in the third section, we tried to get it from the differet points in comperative Law. In this tehesis, there are important points which we noted about Butlan Theory in result. | |
