| dc.description.abstract | Deprem toplum hayatını derinden etkileyen doğal afetlerden biridir. “Deprem” literatürde mücbir sebebe verilen klasik örneklerin başında yer almaktadır. Mücbir sebep, idari faaliyetlerin dışında cereyan eden, önceden tahmin edilmesi ve karşı konulması imkansız olan olaylardır. Mücbir sebep söz konusu olduğunda idarenin hem hizmet kusuruna dayalı sorumluluğu hem de kusursuz sorumluluğu ortadan kalkar. Kusurlu sorumluluğun ve kusursuz sorumluluğun ortadan kalkmasının nedeni mücbir sebep olarak nitelendirilen olayın idarenin eylem ve işlemlerinden kaynaklanmamasıdır. İdarenin teknik imkan ve kabiliyetleri ne kadar güçlü ise sorumluluğu da o kadar yüksektir. Günümüzün modern dünyasında idare ciddi maddi ve teknolojik imkanlara, yetişmiş uzman elemana, istatistiki bilgilere vs. sahiptir. Bu unsurlar “öngörülemezlik” ve “önlenemezlik” ilkelerinin kapsamını daraltmaktadır. Bundan dolayı günümüzde, idarenin mücbir sebep bahanesine sığınarak sorumluluktan kurtulma olasılığının artık daha da zayıfladığından söz edilebilir. Ayrıca mücbir sebep göreceli, nispi bir kavramdır. Daha açık anlatımla bir olay farklı yer, zaman ve şartlarda mücbir sebep niteliğinde sayılabilir ya da sayılmayabilir. Dolayısıyla depremlerin sık yaşandığı bir bölgede meydana gelecek bir deprem mücbir sebep olarak nitelendirilmeyebilir. | dc.description.abstract | Earthquake is one of the natural disasters that deeply affect the society. In the literature, "earthquake" is one of the leading classic examples of force majeure. The force majeure are the events those take place out of the administrative activities and which are impossible to predict and resist previously. When force majeure is in question, either fault liability or absolute liability of the administration disappears. The cause of the disappearance of fault and absolute liability is the event called force majeure which is not resulted from administrative action and processes. The more powerful technical capability is the more responsibility of administration. In today's modern world, the administration has serious financial and technological capabilities, trained experts and statistical information etc. These elements narrow the content of "unpredictability" and "unavoidability" principles. Hence today, it can be mentioned that the possibility of escaping responsibility of the administration by using the excuse of force majeure is decreased. In addition, force majeure is a relative concept. In other words, depending on the place, time and conditions an event can be regarded as force majeure or not. Therefore, an earthquake that would occur in a region experienced frequent earthquakes may not be considered as force majeure.
