| dc.description.abstract | Bu çalışmada; ülkemizde kamu güvenliğini ve huzurunu korumak ve kollamakla görevli kurumlardan biri olan, Emniyet Teşkilatı mensuplarının kendilerine kanun koyucu tarafından yasalarca tanınmış yetkilerinden birisini oluşturan “Polisin Zor Kullanma Yetkisi” açıklanmıştır. Çalışma, giriş ve üç bölümden oluşmaktadır. Birinci bölümde; genel olarak polis kavramının tanımı yapılarak, tarihsel gelişimi ortaya konulmuş, polisin nitelikleri, sınıflandırılması, görev ve yetkileri açıklanmıştır. İkinci bölümde; zor kullanma kavramı ve kapsamı, zor kullanma yetkisinin şartları ve sınırları, polisin zor kullanabileceği haller, zor kullanma yöntemleri, bir zor kullanma şekli olarak polisin silah kullanma yetkisi açıklanmıştır. Üçüncü bölümde ise; polisin zor ve silah kullanma yetkisini aşmasından kaynaklanan sorumluluk halleri ve yargılama usulü açıklanmıştır. | |
| dc.description.abstract | İn this study, the competence of police in using force which has been one of the competences of the members of the Police Organization, one of the in charge institutions that save the public security and protect and watch for the peace in our country is tired to be explained. This authority is known by the law constructors through the laws. This study is formed by an introduction and other three parts. İn the introduction part, the definition of police concept has been made in general then its historical development has been made defined. İn the first part, the qualification of police, the classification of them, their auties and auithoritise have been explained. İn the second part, the concept of using force and its contents, the conditions of the competence of using force and the legal limits and the conditions that police can use force, the methods of using force, the competence of using gun like the way of using force have been explained. In the third part, the conditions of having responsibilities in ultra vires action and using force and the ways of being prosecuted have been explained. | |
