Özet
Efor; zihin ve bedence ortaya konan güç, çaba veya gayret, güç gösterme ve güç harcama, zihince ve bedence ortaya konan çaba, emek anlamlarını da taşımaktadır. İnsanlar bir işi efor ve güç sarf ederek yaparlar. Her iş kendi kapsamınca bir enerji gerektirir. Efor (güç) kaybı; beden gücü eksilen kişinin, kazançlarında bir azalma olmasa bile aynı işi yaparken, aynı işi yapanlara ve yaşıtlarına göre daha fazla “güç ve efor” harcayacak olmasıyla ortaya çıkan bir kavramdır. Mahkemenin istemiyle; terör saldırısı sonucu yaralanan olgunun atandığı yeni yerinde, normal sağlam bir personelle aynı işi yaparken ona göre daha fazla efor sarf ettiği iddiasıyla açtığı tazminat davasında fazla efor sarf edip etmediği, etti ise ne kadar olduğuna yönelik bilirkişi raporu hazırlanması istenilmiştir. Travmaya maruz kalan kişi, bedensel bütünlüğünde meydana gelen zarar sonucunda yaptığı ve yapacağı işlerde daha fazla efor sarf etmek durumunda kalırsa travmaya neden olan kişiden meydana gelen efor kaybının maddi karşılığını “efor kaybı tazminatı” olarak isteyebilir. Günümüzde sıkça kullanılan kavramlar arasında yer alan efor kapasitesi kaybı tazminatı, kişinin yaralanması sonucu belirli ölçeklerle hesaplanır. Hangi yaşta olursa olsun, beden gücü kaybına uğrayan kişilerin günlük yaşamlarını sürdürürlerken, sakatlıkları oranında zorlanacak olmaları nedeniyle mutlaka bir tazminat hesabı yapılması gerektiği yaygınlaşmış olup, bu konu üzerine dikkat çekilmiştir. Efor kapasitesi kaybı hesaplama sırasında literatür araştırılmış ancak literatürde bu durumu açıklayıcı herhangi bir kaynağa rastlanmamıştır.
Effort; means the power exerted by the mind and body. People work in a job with effort and force. Every job requires energy to its own extent. Decreased effort capacity is a concept that arises out when the person whose body strength is reduced will spend more “effort” while doing the same job than his peers, even if there is no decrease in his earnings. The case who was injured as a result of the terrorist attack stated that he was doing the same job with a normal, healthy staff at his new job and then sued for compensation for loss of effort and the court was asked to give expert evidence. The person who exposed to the trauma has to spend more effort on the work and will do as a result of damage to their body integrity, they may demand for the financial compensation of the loss of effort from the person who caused the trauma as a compensation for loss of effort capacity. Among the concepts commonly used today, compensation for loss of effort capacity is calculated with certain scales as a result of the injury of the person. The difficulty rate of working condition is determined by a workplace safety experiment using some certain scales. It has become widespread that people who have lost their physical strength, regardless of age, will have difficulties in their daily lives due to their disability, and that a compensation account must be calculated, attention has been drawn to this issue. During the calculation of effort capacity loss, a literature review was made, but no literature describing this situation was found in the literature.
