dc.description.abstractSeçime ilişkin uyuşmazlıkların çözümlenebilmesi, seçim sonuçlarını etkileyecek olması nedeniyle büyük öneme sahiptir. Bu konuda çağdaş demokratik rejimlerde iki türlü yaklaşımdan söz edilebilir. İlki; denetimi ilgili ülke parlamentosuna bırakmak, ikincisi de bağımsız ve tarafsız olduğu varsayılan yargı organlarına bırakmak. Parlamento denetimi yöntemi; tarafsızlık bakımından tartışma yaratırken yargı organlarının denetimi de demokratik meşruiyet bakımından tartışmalı sonuçlar doğurabilmektedir. İşte bu çalışmada da her iki denetim yöntemi ışığında adil seçim sonuçlarına nasıl ulaşılabileceği çağdaş demokratik ülke deneyimleri de dikkate alınarak tartışılmıştır.en_US
dc.description.abstractDue to its effect on the election results, conflict resolution concerning the election is of great importance. Two types of approaches can be referred to, in this context, in modern democratic regimes. The first one, to delegate the supervision to the parliament of the concerned country. The second one, to entrust it to the judiciary bodies which are assumed to be independent and impartial. While the practice of parliamentary supervision can create debate in terms of impartiality, the supervision of judiciary bodies may result in controversial issues in terms of democratic legitimacy as well. How to obtain fair election results has been discussed within both of the above mentioned supervisory methods through taking into account the experiences of modern democratic countriesen_US
