| dc.description.abstract | Mahkemelerin yargı yetkisi, yargı çevresi ile srlr. Yargı çevresi dışında yargılama faaliyetlerini bizzat yapamazlar, dolayısıyla o yerdeki mahkemeden hukuki yardım talebinde bulunarak işlemi gerçekleştirirler. istinabe, davaya bakan mahkemenin yargı çevresinin dışında (baka mahkemenin yargı çevresinde) yapılması gereken bir işlem için, işlemin yapılaca yerdeki mahkemeden hukuki yardım istemesidir. istinabenin amacı, mahkemenin yargı çevresinin dışında bulunan kişi veya eylerin mahkemeye getirilmesindeki gereksiz zaman ve emek ve giderlerin önlenmesidir. İstinabe olunan mahkeme, istinabe konusu işlemle bar ve davanın esasına ilişkin hüküm veremez. İstinabe, medeni yargılama hukukuna hâkim olan ilkelerle dorudan ilişkilidir. İstinabe, dorudanlık ilkesinin en önemli istisnasr. Ayrıca istinabe, usul ekonomisi ilkesiyle dorudan balantır. İstinabeye ilişkin hükümler, Hukuk Muhakemeleri Kanununda ve diğer Kanunlarda toplu olarak düzenlenmeği ve diğer kanun maddeleri arasında da lm r. Ayrıca usul hukukumuzda, istinabenin sistematiğine ilişkin bir düzenleme yoktur. İstinabeyi tez konusu yapmamın sebebi, uygulamada istinabe hakkında belirsizlik ve karkln olmasr. | dc.description.abstract | Jurisdiction of the Court, with jurisdiction is limited. They cannot personally judge their activities outside the jurisdiction, so that they perform their activities by demanding rogatory from the court where they perform. Rogatory, when the authorized court needs to perform an act in a place other than its own jurisdiction (in a jurisdiction of another court), that court may ask legal assistance from the court where it perform. The purpose of rogatory, is the prevention of unnecessary time and effort and expense in the case that the persons or things to be taken before the court which are not within the jurisdiction of the court hearing the case. The court, which is makes legal assistance, depends on the subject of the rogatory and not able to judge on the merits of the case. Rogatory, which are dominant in civil procedure law with the principles are directly related. Rogatory, is the most significant exception of the principle of immediacy. Also rogatory, is directly linked with the principle of judicial economy. Rogatory related provisions in the Civil Procedure Law and other laws are not regulated collective and they are distributed between other provisions of law. Also in our law system, there are no regulations regarding the systematic of rogatory.
