dc.description.abstractNükleer santral çalışanlarının iyonlaştırıcı radyasyona maruz kalması önlenmesi gereken oldukça önemli bir risktir. Özellikle de nükleer tesislerde yaşanabilecek kazalar, patlamalar, yangınlar veya saldırılar sonucunda meydana gelebilecek radyoaktif sızıntılar hem çalışanları, hem de halkı ve çevrenin sağlık ile güvenliğini yakından etkilemektedir. Bu önemi nedeniyle nükleer güvenliğin sağlanmasına, gerek çalışanların gerekse halkın ve çevrenin korunmasına ilişkin çok sayıda uluslararası düzenleme yapılmıştır. Türk Hukukunda da nükleer santral çalışanlarının iş sağlığı ve güvenliğinin sağlanmasına yönelik düzenlemelerin ülkemizin tarafı olduğu uluslararası sözleşmeler ile AB Direktifleri doğrultusunda hazırlandığı ve uyum içinde olduğu görülmektedir. Fakat nükleer santral çalışanlarının radyasyondan korunmasına ve iş sağlığı ile güvenliklerinin sağlanmasına ilişkin Almanya, Fransa ve ABD Hukukundaki düzenlemeler incelendiğinde mevzuatımızda önemli eksiklikler olduğu göze çarpmaktadır. Bunlara örnek olarak, güncelliğini yitirmiş hükümlerden oluşan yönetmeliklerin hala yürürlükte olması, yeni AB Direktiflerinin getirdiği standartlar kapsamında hükümlerin güncellenmemiş olması, konuya ilişkin mevzuatın kolay anlaşılabilir ve ulaşılabilir bir yapıda olmayıp, aksine oldukça dağınık bir halde bulunmasının uygulama güçlüğü yaratması verilebilir. Henüz yapımı devam eden bir nükleer santral projesinin varlığı da göz önünde bulundurulduğunda, reaktörlerin çalışmaya başlamasından evvel mevzuattaki eksikliklerin hızlıca giderilmesi ve gerekli güncellemelerin yapılması bir zorunluluk olarak ortaya çıkmaktadır. Bu doğrultuda çalışmamızda nükleer santral çalışanlarının iş sağlığı ve güvenliğinin hem uluslararası hem de ulusal hukuk yönünden çerçevesi çizilerek, yabancı ülke hukukları göz önünde bulundurularak, Türk Hukuku bakımından öneriler sunulması amaçlanmıştır.en_US
dc.description.abstractExposure of nuclear power plant workers to ionizing radiation is a very important risk that must be prevented. Radioactive leaks that may occur as a result of accidents, explosions, fires or attacks, especially in nuclear facilities, closely affect the health and safety of both workers, the public and the environment. Due to this importance, many international regulations have been made to ensure nuclear safety and to protect both workers, the public and the environment. In Turkish Law, it is seen that the regulations to ensure the occupational health and safety of nuclear power plant workers are prepared and in harmony with the international agreements to which our country is a party and the EU Directives. However, when the regulations in Germany, France and the USA regarding the protection of nuclear power plant workers from radiation and ensuring occupational health and safety are examined, it is evident that there are significant deficiencies in our legislation. Examples of these include the fact that regulations consisting of outdated provisions are still in force, the provisions have not been updated within the scope of the standards brought by the new EU Directives, the legislation on the subject is not in an easily understandable and accessible structure, on the contrary, it is quite dispersed, creating difficulties in implementation. Considering the existence of a nuclear power plant project that is still under construction, it becomes a necessity to quickly eliminate the deficiencies in the legislation and make the necessary updates before the reactors start operating. In this regard, our study aims to outline the occupational health and safety of nuclear power plant workers in terms of both international andnational law, and to present suggestions in terms of Turkish Law, taking into account the laws of foreign countries.en_US
