İstanbul sözleşmesi Avrupa Konseyi üye devletleri ve gözlemci
statüsündeki devletlerce kabul edilen ve 12 ülkenin kabul edip ulusal
meclislerinden geçirdikten sonra yürürlüğe giren kadına karşı şiddeti ve ev içi
şiddeti önlemeyi, kadını korumayı ve kadına yönelik şiddetin uygulanması söz
konusu olduğunda failini yargılamayı amaç edinen, uluslararası bir sözleşmedir.
Kadının her türlü şiddete karşı korunması anlamında önemli uluslararası
kazanımları içeren bir sözleşmedir. Ancak sözleşme metninin hazırlanışında
kullanılan dil ve sözleşme metninin içine serpiştirilen ve farklı anlamları
çağrıştıran kavramların kullanılması, büyük kazanımları içerisinde barındıran
bir sözleşmeye olan güven ve inancın özellikle samimi dindarlar açısından,
sarsılmasına neden olmuştur. Bu anlamda İstanbul sözleşmesi doktrinde
eleştirilmektedir. Bu makalede de sözleşmenin hakkını teslim ederek,
sözleşmeye yönelik eleştirileri ifade etmeye çalışacağım. Bununla birlikte, 20
Mart 2021’de 3718 sayılı Cumhurbaşkanı kararı ile tam adı, Kadınlara Yönelik
Şiddet ve Ev İçi Şiddetin Önlenmesi ve Bunlarla Mücadele Hakkındaki Avrupa
Konseyi Sözleşmesi feshedilmiş veya kimilerine göre sözleşmeden Türkiye
çekilmiştir. Sözleşmenin feshini düzenleyen İstanbul Sözleşmesi'nin 80.
maddesi uyarınca taraflardan herhangi biri bu sözleşmeyi feshedebilir. Bu
hüküm gereği Türkiye, 1 Temmuz 2021 tarihinde sözleşmeden resmen
çekilmiştir.
The Istanbul Convention is an international convention adopted by the Council of Europe member states and observer states and entered into force after the adoption of 12 countries and their national assemblies, aiming at preventing violence against women and domestic violence, protecting women and prosecuting the perpetrator when it comes to violence against women. It is a convention that includes important international gains in terms of protecting women against all kinds of violence. However, the language used in the preparation of the contract text and the use of concepts interspersed in the contract text and evoking different meanings have caused the trust and belief in a contract that contains great gains to be shaken, especially for sincere believers. In this sense, the Istanbul Convention is criticized in the doctrine. In this article, I will try to express the criticisms of the contract by giving the right to the contract. However, on 20 March 2021, the Council of Europe Convention on the Prevention and Combat of Violence Against Women and Domestic Violence, as its full name, was terminated by the Presidential Decree No. 3718. In accordance with Article 80 of the Istanbul Convention, which regulates the termination of the contract, any of the parties may terminate this contract. This annulment shall enter into force on the first day of the month following the expiry of the three-month period from the date on which the notification is received by the Secretary General of the Council of Europe. Pursuant to this provision, Turkey has officially withdrawn from the contract on 1 July 2021.
