| dc.description.abstract | Yirminci Yüzyılda, Avrupa’yı kan ve ateşe boğan, tüm dünyayı etkileyen ve milyonlarca insanın ölümüne neden olan iki Dünya savaşının yarattığı olumsuzlukların sonucunda, bir daha benzer felaketleri yaşamamak için oluşturulması düşünülen Avrupa Birliği, kayda değer bir ilerleme göstererek devletleşme aşamasına gelmiştir. Ocak 2005’te kabul edilen Avrupa Birliği Anayasası ile, 50 yıllık bir serüvende, son aşama olmamakla birlikte, önemli bir dönüm noktasına gelinmiştir. AB’nin başarısı, bundan sonraki benzer girişimler için bir olumlu örnek, başarısızlığı ise, uzun sürecek bir karmaşanın başlangıç noktası olmaya adaydır. Bir “Medeniyet Projesi” olarak lanse edilen Avrupa Birliği girişimi, bulunduğu nokta itibarıyla, sancılı bir dönemden geçmektedir. Bu aşamadan itibaren, Avrupa Birliği üyesi devletler, bugüne kadar Birlik’ten elde ettikleri ile bu aşamadan sonra, daha yüksek insanlık ideallerine ulaşmak için, vazgeçmeleri gereken değerlerin muhasebesini yapmaktadırlar. Çalışmanın birinci bölümünde; Avrupa Birliği’nin tarihsel temelleri ile, Birliğin temelini oluşturan topluluklardan bugüne kadar geçilen aşamalar özetlenerek, Avrupa Birliği’nin hangi koşullar altında, hangi amaçlarla kurulduğu ve bugüne kadar hangi aşamalardan geçtiği incelenmiştir. İkinci bölümde; üye devletlerin onayına sunulan AB Anayasası ile getirilmek istenen yapılanma incelenerek, AB Anayasası’nın ne ölçüde devletleşme esasları getirdiği anlaşılmaya çalışılmıştır. Üçüncü bölümde; gelinen aşamada, oluşturulmaya çalışılan devlet biçimi olarak düşünülen Federalizm incelenmiş, mevcut federal uygulamalardan bazı örnekler verilmiş ve AB Anayasası ile getirilmek istenen sistemin federal bir sistem olup olmadığı irdelenmiştir. Dördüncü bölümde; AB Anayasası ile getirilmek istenen kurumsal yapı değerlendirilerek devletleşme esasları irdelenmiş, AB’nin ulaşmak istediği hedef konusu açıklığa kavuşturulmaya çalışılmıştır. Sonuç bölümünde ise; gelinen aşamada, AB’nin oluşturmaya çalıştığı sistemin mevcut uygulamalardan farklı olduğu, değişen ve gelişen durumlara göre AB’nin, geriye dönmemek üzere, kendine özgü bir yapı oluşturarak yoluna devam edeceği vurgulanmıştır. | |
| dc.description.abstract | In the 20th century , the EU, which was established to prevent disasters as two world wars, that effected whole world and caused millions of human death and strangled the Europe in blood and fire, has had a great progress and has come to the rank of becoming a state. With the EU Constitution, accepted in january 2005, in a 50 years long adventure, a turning point is reached, but not the last rank. The success of the EU will be a positive example for future similar attempts, otherwise, the failure will may be a starting point of a long term confusion. Launching as a “Civilisation Project”, the EU is passing through a painful term. By this grade, the member governments of EU are evaluating the profits that they had from the EU until today and values that they have to give up for reaching higher ideals of humanity. In the first chapter; by summarizing the phases which was passed from the communities constructed the base of union through today; it is investigated in which conditions, in which purposes the EU was established and the EU has passed through. In the second chapter; the construction which wanted to bring with, the EU constituton submit to approval of member countries, is inquired in order to try to figure out the size of govermental essential, which are brougt by the EU. In the third chapter; federalism, which is thought to be the form of state, is inspected, some examples are given of present applications and it is investigated whether the EU constution and desired system are same or not. In the fourth Section, The organization structure, which is posed by the EU constitution, is evaluated and the governmental fundamentals are investigated. And in conclusion; it is emphasised that in the present position, the EU’s system is different from other applications, and according to changing and improving situations, the EU will continue in his way forming an original construction without turning backward. | |
