| dc.description.abstract | Yargı Bağımsızlığı ilkesi, çağdaş demokrasilerin ve Hukuk Devleti ilkesinin vazgeçilmez unsurudur. 1982 Anayasasında, yargı bağımsızlığı incelendiğinde, Hukuk Devleti ilkesi ile bağdaşmayan birtakım eksikliklerin mevcut olduğu görülmektedir. Özellikle, yargı bağımsızlığının onsuz olmaz şartlarından biri olan yargıçlık teminatı konusunda bu eksiklikler çok belirgindir. Bu noktada yapılması gereken, bu eksiklerin giderilip, yargı bağımsızlığının bütün kural ve kurumları ile güvenceye kavuşturulmasıdır. | |
| dc.description.abstract | The Principle of Adjudication Independence is an element that can't be given up for contemporary Democracies and rule of law Principle. When Adjudication Independence of 1982 Constitution is examined carefully some deficiencies that can't harmonize with rule of law Principle have been observed. Especially these deficiencies are evident in the subject of judgeship guaranty, which is one of the provisions of Adjudication independence that can't be done without. The important thing to do in that point is to remove the deficiencies and to reunite all rules and foundations of the adjudication independence as a guarantee. | |
