| dc.description.abstract | Bu çalışmada uluslararası hukuka göre suç sayılan soykırım (genocide) kavramı üç bölümde incelenmiştir. Birinci bölümde, soykırım kavramının doğuşu, kavramın yaratıcısı olan Raphael Lemkin?in bu kavrama yaklaşımı ve soykırım suçunun uluslararası hukukta barındırdığı nitelikler ele alınmıştır. İkinci bölümde, soykırım suçunun tanımı ve unsurları; soykırım suçunun barındırdığı kısmen veya tamamen yok etme özel kastı, suçun mağdur grupları; suçu oluşturan fiilleri de kapsayacak şekilde anlatılmaya çalışılmıştır. Bu değerlendirmeler 1948 tarihli Soykırım Sözleşmesi ekseninde yapılırken sözleşmeden kaynaklı yetersizlikler ideal hukuk ekseninde eleştiriye tabi tutulmuştur. Üçüncü ve son bölümde ise soykırım suçundan dolayı devletlerin ve bireylerin sorumlulukları ast-üst ilişkileri de göz önünde bulundurularak incelenmiştir. Devamla, uluslararası ceza yargılamalarına emsal teşkil eden ad hoc nitelikli uluslararası mahkemeler ve süreğen bir yapıya sahip olan Roma Statüsü ile devletlerin yargı yetkisini tanıdıkları Uluslararası Ceza Mahkemesi incelemeye alınmıştır. Sonuç olarak soykırım kavramının, 1948 tarihli Soykırım Sözleşmesi kapsamındaki muhtevasının gelişen toplumsal yaşam ve modern hukuk karşısında yetersiz kaldığı ve tekrar gözden geçirilmesi gerektiği vurgulanmıştır. | dc.description.abstract | In this study, the concept of genocide, which is regarded as a crime pursuant to international law, has been examined in three chapters. In the first chapter, the emergence of the concept of genocide, the approach of Raphael Lemkin - who is the creator of this concept - to this concept and the nature of the crime of genocide within international law have been also handled. In the second chapter, the description and factors of the crime of genocide, specific intent of partly or completely destruction within the crime of genocide and the victim groups of the crime have been tried to be explained including the criminal conducts. While these assessments have been made in accordance with the UN Convention on the Prevention and Punishment of the Crime of Genocide dated 1948, the deficiencies arising from the Convention has been subjected to criticism in accordance with ideal law. In the third and last chapter, the responsibilities of the states and the individuals due to crime of genocide have been studied by taking the superior-subordinate relationship into consideration. Thereafter, the ad-hoc international courts, which set a precedent for the international criminal procedures, and the International Criminal Court, to which the states entitled jurisdiction with the Rome Statute that has a perpetual structure, have been studied. As a result, it has been emphasized that the content of the concept of genocide within the scope of the UN Convention on the Prevention and Punishment of the Crime of Genocide dated 1948 remain incapable in the face of developing social life and modern law and that it is required to be reviewed.
