| dc.description.abstract | 1982 Anayasasının 2. maddesinde belirtilen sosyal devlet il¬kesi ile insan onuruna yaraşır bir yaşam konusunda güçsüzlerle yardıma gereksinimi olanların korunması amaçlanır. Sendika kurma hakkı, her ne kadar önceleri işletmeler karşısında güçsüz kalan işçiler için düşünülmüşse de, daha sonra büyük sendikalar karşısında güçsüz kalan küçük işletmeler için de şart olmuştur. Sendika kurma hakkına ilişkin Anayasanın 51. maddesinde belirtilen, anayasal devlet, sosyal devlet, sosyal hak, sendika, millî güvenlik, kamu düzeni, suç işlenmesinin önlenmesi, genel sağlık, genel ahlâk, hak ve özgürlük, işçi, işveren, işkolu, Cumhuriyetin nitelikleri ve demokratik esasların bilinmesi ve açıklanması gerekmektedir. Bu çalışmada Sendika Kurma Hakkı tüm yönleriyle incelenmeye çalışılmıştır. Öncelikle sosyal devlet ve sosyal haklar açıklanmıştır. Daha sonra sendika ve dünyada sendikacılık üzerinde durulmuştur. Son olarak Türk Anayasaları çerçevesinde Sendika Kurma Hakkı ele alınmıştır. Sonuç olarak, sendika kurma hakkı; güçlünün karşısında güçsüzü korumaya çalışan sendikaların kurulabilmeleri için büyük önem taşımaktadır. | |
| dc.description.abstract | It is aired protecting to people which are powerless and need to help about a honored life and social government principle which explains at the second substance at 1982 Constitution. Union construction justice, although remaining weak in the face of businesses for the workers was thought at first, then it hah become necessary for small businesses which remain powerless in the face of large trade unions. 51st substance of the Constitution concerning union construction justice stated to in the constitutional state, social state, social rights, trade union, national security, public order, crime prevention, public health, public morality the right and freedom, workers, employers, sector, the republics qualifications and democratic principles should be known and explained. In this study, Union Construction Justice has been tried to examine with all aspects. First the social state and social rights had been explained. Then it had been focused on unionism on trade union and in the world. At the last, union construction as turc constitutions had been considered. As a result, union construction is of great importance to be built the trade unions which try to protect the weak against the powerful union. | |
