dc.description.abstractHekimlik mesleğinin temel unsurunun insan olması, bu mesleğin geçmişinin çok eskilere dayanmasını sağlamaktadır. Tıp biliminin uygulayıcısı olan hekimlerin görevi, hastalıkları teşhis ve tedavi etmektir. Hekim, hastasını yeniden eski sağlığına kavuşturmak için çeşitli tıbbi müdahalelerde bulunur. Tıbbi müdahalenin amacı hastasının zarar görmemesi için mesleki tüm şartları yerine getirmek, hastanın durumunu, tıbbi açıdan zamanında gecikmeksizin saptayıp, somut durumun gerektirdiği önlemleri eksiksiz biçimde almak, uygun tedavi yöntemini de gecikmeden belirleyip uygulamak zorundadır. Bu durum da hekimin sorumluluğunu ortaya koymaktadır. Hekimlik mesleği gibi hekimin mesleki sorumluluğunun da kökeni çok eskilere dayanmakta olup bu çalışmamızda özellikle günümüz mevzuatı ve Yargıtay kararları eşliğinde hekimlerin mesleki sorumluluğunu ortaya çıkran hukuki durumlar, hukuki statüleri, şartları ve hukuki neticeleri detaylıca incelenmiştir. Özellikle tıbbi hatalı müdaheleye karşı Yargıtay'ın hangi bakış açısına sahip olduğunu kararları doğrultusunda incelediğimiz tezimizin son kısımda ülkemizde diğer mevzuat hükümlerine göre çok yeni sayılacak zorunlu mesleki sorumluluk sigortasına da değinilmiştir.
dc.description.abstractThe fact that the basic element of the profession of medicine is the human being ensures that the history of this profession dates back to ancient times. The task of physicians, who are the practitioners of medical science, is to diagnose and treat diseases. The physician performs various medical interventions to restore the patient to his/her former health. The purpose of medical intervention is to fulfill all professional conditions in order to prevent harm to the patient, to determine the patient's condition in a timely manner from a medical point of view, to take the measures required by the concrete situation in a complete manner, to determine and apply the appropriate treatment method without delay. The origins of the professional responsibility of the physician, like the profession of medicine, are very old and in this study, the legal situations, legal status, conditions and legal consequences of the professional responsibility of physicians have been examined in detail, especially in the light of today's legislation and the decisions of the Court of Cassation. In the last part of our thesis, in which we examine the point of view of the Court of Cassation against medical malpractice in line with its decisions, the compulsory professional liability insurance, which will be considered very new in our country compared to other legislation provisions, is also mentioned.
