Kadına yönelik şiddetin önlenmesinde denetimli serbestlik uygulamalarının rolü

Abstract

“Kadına Yönelik ġiddetin Önlenmesinde Denetimli Serbestlik Uygulamalarının Rolü” baĢlıklı yüksek lisans tez çalıĢması, Kamu Hukuku Yüksek Lisans programında, Hukuk Felsefesi ve Sosyolojisi Ana Bilim Dalı kapsamında hazırlanmıĢtır. ÇalıĢmanın ilk bölümünde Ģiddet olgusu, nedenleri ve teorileri ele alınmıĢ; kadına yönelik Ģiddet ve aile içi Ģiddetin tanımı, unsurları, sosyolojik nedenleri, biçimleri ile bu soruna karĢı geliĢtirilen mücadelenin tarihsel geliĢimine değinilmiĢtir. Dünyada ve ülkemizde kadına yönelik Ģiddetle ilgili bazı istatistik veriler ve araĢtırmalar değerlendirilerek yaĢ, sosyal-ekonomik durum, eğitim, bölge gibi farklı unsurların kadınlara yönelik Ģiddet üzerindeki etkileri açıklanmıĢtır. Ġkinci bölümde, suç ve ceza olgularının sosyolojik ve hukuksal açıdan yapılan farklı tanımlarına yer verilmiĢ, suç ve ceza teorileri ile ceza adaleti felsefeleri anlatılmıĢtır. Denetim ve gözetim sistemlerinin modernite öncesi ve sonrasındaki biçimleri ele alınmıĢ, Foucault‟nun biyoiktidar kavramı üzerinden modernizm sonrasındaki denetim ve gözetim sisteminin amaç ve iĢlevleri açıklanmıĢtır. Cezalandırma anlayıĢında yaĢanan dönüĢümün ele alındığı ikinci bölümden sonra, üçüncü bölümde alternatif cezalandırma arayıĢlarının bir ürünü olarak denetimli serbestlik sistemi ele alınmıĢtır. Kadına yönelik Ģiddet suçlarında mevcut cezalandırma sistemi yasal düzenlemeler ve uygulamadaki durum bakımından değerlendirilmiĢtir. ÇalıĢma, son olarak cezalandırma anlayıĢında yaĢanan dönüĢümün kadına yönelik Ģiddet suçları üzerindeki etkisinin değerlendirilmesi ve buna iliĢkin kanaatimizin belirtilmesiyle tamamlanmıĢtır. In the first part of the study the phenomenon of violence, its causes and theories are discussed, the definition of violence against women and domestic violence, elements of the sociological reasons, The historical development of the struggle against this problem developed was discussed. In the world and in our country some of the statistical data and researchs on violence against women evaluated, age, social- economic status, education, violence against women, different elements on the effects of violence against women like the territory was explained. In the second part, sociological and legal aspects of crime and the criminal cases are defined in different, the criminal justice theories and philosophies of crime and punishment was explained. Pre-and post-modern forms of supervision and surveillance systems are considered, Through Foucault's concept of bio-power the concept of post- modernism, objectives and functions of control and supervision system was described. The second section dealt with the transformation of the concept of punishment, as a product of the third section, the search for alternative sentencing probation system were discussed. Crimes of violence against women were evaluated in terms of the status and implementation of the existing legal regulations punishment system. The study finally finished punish the understanding of the impact on the transformation of violent crimes against women, and the corresponding specification of judgment has been completed.
