Kılıç, Muhammed TayyibYaşar, Mehmet Aziz2017-11-202017-11-2020172017-06-08https://hdl.handle.net/11468/3439Çalışmamızın konusu Memlûkler devletinde idârî ve adlî birçok vazifeyi deruhte eden, dönemin önemli medreselerinde müderrislik yaparak çok sayıda âlim yetiştiren ve usûl ilminde fukahâ ve mütekellimîn metotlarının sentezlendiği memzûc metodun en güzel örneğini veren Şâfiî âlim Tacüddîn es-Sübkî’nin hayatı, eserleri ve usûl düşüncesini kapsamaktadır. Çok yönlü bir âlim olan Sübkî başta tarih, fıkıh ve hadis olmak üzere İslâmî ilimlerin birçok alanında birbirinden değerli çeşitli eserler telif etmiştir. Ancak O’nun, İslâm medeniyetinde esas iz bırakan yönü usul alanındaki çalışmalarıdır. Bu bağlamda çalışmamızda Sübkî’nin gerek düşünce ve fikir açısından gerekse usûl eserlerindeki metot açısından hangi usûlcülerden etkilendiği, usûl eserlerinin yazımında izlediği metot, kendisinden sonraki usûlcülere etkisi, başta Cem?u’lCevâmi? olmak üzere eserlerinin fıkıh tarihindeki yeri gibi hususlar tezde ele alınmış başlıca konulardandır. Ayrıca Sübkî’nin eserleri kendisinden önceki usûlcülerin eserleriyle mukayese edilerek Sübkî’nin orijinalitesi ortaya konmaya çalışılmıştır. Sübkî’nin el-Minhâc ve Muhtasar isinli metinlere yazmış olduğu el-İbhâc ve Raf‘u’l-Hâcib isimli şerhlerinin bu metinler üzerine diğer müellifler tarafından yazılmış şerhlerden farklı olan yanları belirtilmiştir. Aynı şekilde diğer muhtasar metinlerden farklı olarak Cem?u’l-Cevâmi?de izlemiş olduğu üslup ve metodu da ortaya konulmuştur. Ayrıca Şâfiî mezhebine mensup olmakla birlikte usul düşüncesinde Şâfiî usulcülere muhalif olduğu konular da işlenmiştir. Anahtar Kelimeler : Fıkıh Usûlü, Şâfiî Mezhebi, Tâcüddîn es-Sübkî, Memlûkler, Cem?u’lCevâmi?The topic of our study is the juristical methodology of Tacuddin as-Subkî a well-known Shafiîscholarwho has taught in manymadrasahs of the era and trained a great number of studentsas well as taking charge of many administrative and judicial positions in the Mamluk Sultanate. In this regard, firstly the time that he lived in and his scientific personality are examined and his boks are introduced. Although he has paid attention mainly to history, fiqh and hadith and all the other Islamic sciences, he was well known of his methodology in fiqh and was recognized as a methodologist. It is important for our study to clarify the methodological aspects of Subkî. Therefore, in our study it is aimedat determining the points that affect these aspects. In this respect wewanted to find out whom affected to subkî’s thoughts and methodology, his methodology in writing his methodological works, how he was perceived by his successor methodologists and how he affected on their own methodologies and the position of his book called “Cem?ul-cevâmi?” in the methodology of fiqh. Inaddition, we wanted to determine Subkî’stabaqah, thus his position between the mudjtahids, depending on his opinions that he has preferred differently fromhis madhab and depending on the ascriptionsof his successors to him.
