Divan-ıHümayun’ a yapılan başvurulardaki şikayetlerin çözümüne dair ahkamkayıtları mera, yaylak, kışlak, çayır, otlak gibi köy orta mallarınınkullanımınayönelikşikayetlerinoldukçayoğunolduğunugöstermektedir.1858 tarihli Osmanlı Arazi Kanunnamesi, 19. yüzyılın ikinciyarısında Osmanlı İmparatorluğu'nun Tanzimat döneminde sistematikbir toprak reform programının başlangıcı olmuştur. Bu çalışmada 19.yüzyılda, mera, yaylak, kışlak, çayır, otlak gibi alanların kullanımındayaşanan sorunların nedenleri ve Arazi Kanunnamesinin uygulanıpuygulanmadığı tespit edilmeye çalışımıştır. Bu amaçla 1858 AraziKanunnamesi öncesi ve sonrası yasal düzenlemeler ve bu alanlarınkullanımında yaşanan anlaşmazlıklar ile ilgili hüküm kayıtlarınayansıyan örnek olaylar ve çözümler değerlendirilmiştir. Örnek olaylarİstanbul Ahkâm Defterleri' nde yer alan 19. yüzyıla ait hükümkayıtlarından seçilmiştir. Ahkâm Defterleri, 18. yüzyılın ikinci yarısındanitibaren, Divan-ı Hümayun’da, halkın şikayetlerinin görüşülmesindensonra alınan kararların birer suretinin farklı bölgelere ait defterlerekaydedilmesiyle meydana gelen arşiv kaynaklarıdır.Bu örnek kayıtlarda ortaya çıkan anlaşmazlıkların çözümündegenellikle kadimden beri uygulanan genel kuralların devamınınsağlanmaya çalışıldığı ve alınan kararların Arazi Kanunnamesi’ nde yeralan düzenlemelere uygun olduğu görülmektedir. Anlaşmazlıkların nedenlerine bakıldığında ise kullanım hakkına sahip olmayan kişilerinmüdahalesi ile ilgili başvuruların yoğun olduğu söylenebilir.The use of village common goods such as rangelands (mera), summer pastures (yaylak), winter pastures (kışlak) and meadow (çayır) and the disagreements that are present here are important because they can affect the people of the whole region at the social dimensions. Complaints to the Ottoman Divan and related solutions and verdicts used to be recorded in the Ahkam Registers shows that the complaints about the use of village common goods such as rangelans, summer pastures, winter pastures and meadow are very intense. The Ottoman Land Code of 1858 was the beginning of a systematic land reform programme during the Tanzimat period of the Ottoman Empire in the second half of the 19th century. This study attempts to determine the causes of problems in the use of rangelands, summer-hill pastures, winter-pastures, and meadow and whether the Land Code was applied in the 19th century. For this purpose, the case examples and solutions reflected in the provisions records related to the legal regulations before and after The Ottoman Land Code of 1858 and the disputes that are experienced in the use of these fields have been evaluated. The case examples were selected from the records of the provisions of the 19th century in İstanbul Ahkâm Registers. Ahkâm Registers is the archival resources of Divan-i Hümayun since the second half of the 18th century, when some of the decisions taken after the people's complaints were recorded in books belonging to different regions. It is seen that the resolution of the disputes arising in these sample records is generally in accordance with the regulations in the Land Code and the decisions that have been taken and the continuation of the old rules and bases applied.
