dc.description.abstract21.07.2020 tarihinde Resmî Gazete’de yayınlanan “Define Arama Yönetmeliğinde Değişiklik Yapılmasına Dair Yönetmelik” ile Define Arama Yönetmeliğinde önemli değişiklikler yapılmıştır. Bu değişiklikler ile mevcut bazı hükümler değiştirilmiş ve yeni bazı hükümler eklenmiştir. Kanun koyucuyu bu değişikliği yapmaya iten olay, kanaatimizce 2019 yılında dipsiz gölde izinli şekilde yapılan define kazısıdır. Halk tarafından Dipsiz göl olarak adlandırılan göl Gümüşhane’de merkeze bağlı Dumanlı köyünün sınırları içinde bulunmaktadır. Söz konusu bu Göl’ün altında “define” olduğunu düşünen iki vatandaş izinli bir şekilde define aramak istemişler ve bu amaçla yetkili makamlara başvuruda bulunmuşlardır. Yetkili makam tarafından bu kişilere define arama ruhsatnamesi verilmiş ve yine yetkili makamlar tarafından görevlendirilen kişilerin gözetiminde, izin alan vatandaşlar define arama işlemini gerçekleştirmiştir. Gerekli izinleri alan kişiler tarafından gölün altında define aranması sırasında göl suyu tahliye edilmiş, eski hâline getirilmeye çalışılsa da başarılı olunamamıştır. Bu çalışmada; dipsiz gölde yapılan izinli define kazısı neticesinde Define Arama Yönetmeliğinde yapılan değişiklikler ele alınacak ve konuya ilişkin değerlendirmelerde bulunulacaktır.en_US
dc.description.abstractConsiderable amendments were made to “Regulation of Legal Treasure Hunting” with Regulation of Amendments on Regulation of Legal Treasure Hunting that published in Official Gazette on 21.07.2020. With these amendments, some existing provisions were altered and some new provisions were supplemented. The circumstance that prompted the Legislative to make this amendment is the authorized excavation in the “dipsiz göl” in 2019. The lake, which is called Dipsiz lake by the people, is located within the borders of Dumanlı village in Gümüşhane. Two citizens, who thought that there was a “treasure” under this Lake, wanted to search for treasure with permission and applied to the authorities for this purpose. A treasure search license was given to these people by the competent authority, and under the supervision of the persons assigned by the authorities, the citizens who obtained permission carried out the treasure search. During the search for treasure under the lake by the people who obtained the necessary permits, the lake water was evacuated, and although attempts were made to restore it, it could not be successful. In this study; the amendments made in the Regulation of Legal Treasure Hunting as a result of the authorized treasure excavation in the “dipsiz lake” will be discussed and assessments will be made on the subject.en_US
